Johnny Depp’s side released a video showing James Franco visiting Amber Heard at midnight when Johnny Depp was away. The two were living together at the time.
According to video footage extracted from the elevator on May 22, 2016, James Franco and Amber Heard entered the elevator together. Actress Amber smiled brightly while James wore a baseball cap and looked down. They leaned their heads against each other as the elevator doors closed. They then entered Amber and Johnny Depp’s penthouse in Los Angeles.

Sources indicate that this video was taken just one day before Amber filed for divorce. Johnny Depp believes that Amber brought James Franco to his house for the night, knowing full well that he was away. Amber, however, testified in court that she was unaware of Johnny Depp’s schedule.
During the trial, lawyer Camille Vasquez, representing Johnny Depp, questioned Amber Heard about her relationship with actor James Franco. However, the actress denied the affair and claimed Johnny was blindly jealous to the point of physically abusing her.
Amber Heard insists James Franco is just a close friend and neighbor: “He’s my friend and literally lives next door.” Explaining the intimate photos in the elevator, Amber said that after seeing her (injured) face, James Franco leaned his head on her shoulder and also touched one of her cheeks to comfort her. Amber had previously released a photo of her bruised face after the altercation on May 21st.
